HeliTrak Standard Limited Warranty

HeliTrak, Inc. (HeliTrak) warrants that it will either repair, replace, remanufacture or refund the purchase price for any HeliTrak product that fails to operate, in normal ordinary course use, in conformity to HeliTrak’s published specifications due to a defect in materials or workmanship during the warranty period for that product, subject to the terms set forth below.

Warranty Period

New

24 months or 400 flight hours from the date of installation, or 30 months from the date of purchase, whichever comes first.

OEM remanufactured

12 months or 200 flight hours from the date of installation or 18 months from the date of purchase, whichever comes first.

Overhauled or repaired

6 months or 100 flight hours from the date of installation, whichever comes first, provided the overhaul/repair was carried out by an appropriately approved FAA repair facility.

In the event of a valid warranty submission, the choice of remedy (i.e. repair, replace, remanufacture, or refund the purchase price) will be at HeliTrak’s sole discretion. HeliTrak reserves the right to use remanufactured replacement parts for repairs. The parts and labor associated with the repair, replacement, or remanufacture will be at no cost to the customer provided the customer be responsible for any costs incurred for transportation between the customer and HeliTrak for the warranty item(s).

This warranty does not apply to: (1) cosmetic damage, scratches, dents, etc.; (2) consumable parts, such as friction material or other parts necessary for periodic maintenance and inspections, unless product damage has occurred due to a defect in material or workmanship; (3) damage caused by accident, abuse, misuse, water, flood, fire, or other natural or external causes; (4) damaged caused by service performed by anyone who is not authorized or appropriately approved to service the product; (5) damage resulting from improper installation or connection of the product; (6) products in which maintenance and inspection requirements have not been met; (7) products that have been altered or repaired in any way without written permission from HeliTrak.

HeliTrak reserves the right to inspect the product upon return to confirm warranty eligibility. Each product must have been previously registered (using the registration form found on the latter portion of this document) to be eligible for warranty coverage. The ultimate determination of whether a product qualifies for warranty coverage is at HeliTrak’s discretion. HeliTrak also reserves the right to deny warranty claims for products that are obtained and/or used illegally.

Warranty coverage for a repaired product shall tie back to the original product timeline. For example, if 18 months have passed and 300 flight hours flown from date of install of a new product, the warranty coverage for the replacement will be an additional 6 months and 100 flight hours, whichever comes first.

The warranties and remedies contained herein are exclusive. HeliTrak disclaims all other warranties, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, non-infringement and any implied warranty arising from course of performance, course of dealing or usage of trade. In no event shall HeliTrak or its affiliates be liable for any incidental, special, indirect, or consequential damages, whether resulting from the use, misuse, or inability to use the product (or the aircraft in which the product is installed) or from defects in the product. In no event shall HeliTrak or its affiliates’ liability exceed the purchase price of the product.
